Government Affairs Committee Adopts Recommendation to Amend 60:40 Ordinance

Last week the GILCCC Government Affairs Committee unanimously adopted a recommendation for the City to amend the so-called "60:40 Ordinance" concerning restaurant food and alcohol sales in Irving.  The proposal would revise the food and beverage sales ratio to 40:60 for restaurants and help address burdensome reporting requirements.

A coalition of restaurant and property owners are seeking the amendment to better reflect actual price inflation for their products in recent years.  In addition, the proposed reporting requirements would create more certainty for businesses and eliminate enforcement inconsistencies.  

The Chamber's Board of Directors will consider the Committee's recommendation at its March 27 meeting.  If approved, a resolution would be forwarded to the City Council for their consideration.

Texas Comptroller Announces Tax Amnesty for Businesses

Texas Comptroller Susan Combs has announced the opportunity for businesses to clear up their tax records without any penalty. The state's Fresh Start tax amnesty period is set for June 12 through Aug. 17, 2012.

"The amnesty is a chance for businesses to set their tax records straight and save money by not having to pay penalty and interest on tax reports they had failed to file," Combs said. "During the two-month amnesty businesses can file those missing reports and pay the overdue taxes, or amend and pay previous reports in which they had incorrectly stated a lower amount than was due."

The tax amnesty covers taxes and fees that were originally due before April 1, 2012. The amnesty does not apply to underpaid tax returns (tax that was reported but not paid) or filing periods that businesses have in audit.

The Fresh Start amnesty applies to sales tax, franchise tax and other state or local taxes or fees administered by the Comptroller's office, except Public Utility Commission gross receipts assessments.

A similar tax amnesty was held in summer 2007 and brought in approximately $100 million in unpaid taxes.

Legislative Update

Next Tuesday, the Senate is set to begin floor debate on S.1813, "Moving Ahead for Progress in the 21st Century." The highway and transit authorization package represents bipartisan compromise, includes significant federal program reforms, and, by maintaining investment levels, will support thousands of jobs. The U.S. Chamber and the Americans for Transportation Mobility Coalition strongly support this legislation as introduced and are calling on the Senate to pass it with strong bipartisan support.

We also expect action in the House next week: amendments are due to the House Rules Committee by Monday at 3 pm, and the House Rules Committee is scheduled to meet on Tuesday at 5 pm to consider them. Although concerned about the treatment of public transportation funding in this legislation, the U.S. Chamber generally supports H.R. 7, the "American Energy and Infrastructure Jobs Act of 2012" as reported by the House Transportation and Infrastructure Committee and expects to call for its passage.

  • Send a letter to your individual members of Congress
  • Arrange for a group of businesses to meet with your Members of Congress when they are home for the President's Day Recess (Feb 20-24) or on the weekends to stress the importance of a fully-funded highway and transit bill.  Here are some  talking points to use.

Linda Harper-Brown Receives "Champion of Free Enterprise" Award from Texas Association of Business

During Representative Linda Harper-Brown's career, she has focused on keeping Texas businesses friendly and promoting the business atmosphere in Irving.  She recently was recognized by the Texas Association of Business (TAB) for her efforts and was awarded "Champion of Free Enterprise."

Call To Action

Congress is considering federal legislation to extend Unemployment Insurance (UI) benefits and an agreement must be made by the end of February when the newest extension expires. The legislation sits in a Senate Conference Committee and includes provisions that allow states to drug test UI recipients. This same language was included in a House bill in December that failed.   

The use of illegal drugs, or even the misuse of prescription drugs, directly affects employment. Drug testing programs in the private sector have been shown to improve absenteeism rates, reduce accident rates, and improve employee productivity as well as employee turnover.  

States are not allowed the option to adopt legislation that may require unemployment insurance recipients to take a drug test to qualify for benefits. The unemployment insurance system is meant to provide benefits to those who have lost their jobs through no fault of their own and who are available to work. If a recipient tests positive for drugs then he or she is technically not available to work.  

Tell your legislator to keep this language in the final bill. Employers should not foot the bill for those who intentionally use illegal drugs, and therefore are not available to work.

Stage 3 Water Restrictions - Drought Contingency Plan

Stage 3 of the City of Irving Drought Contingency Plan is now in effect. Until further notice, all residents and businesses can water only once per week on designated days.

Industrial, commercial and multifamily locations ending in even-numbered addresses (0, 2, 4, 6 or 8) can water on Tuesday only; industrial, commercial and multifamily locations ending in odd-numbered addresses (1, 3, 5, 7 or 9) can water on Wednesday only. No irrigation may occur on Monday, Thursday or Friday, and irrigation is prohibited between 10 a.m. and 6 p.m. on any day.

Residences ending in even-numbered addresses (0, 2, 4, 6 or 8) can water on Saturday only, and residences ending in odd-numbered addresses (1, 3, 5, 7 or 9) can water on Sunday only.

All requirements from Stage 1 and Stage 2 remain in effect during Stage 3. Violators are subject to fines of up to $2,000. For more information, visit www.cityofirving.org or call (972) 721-2281.

U.S. Chamber Launches Six State Effort to Educate Voters on Important Issues Affecting the Economy

The U.S. Chamber of Commerce launched six new television ads today to ensure that voters are educated on important issues affecting the economy. The ads will air on network and cable in 15 markets across six states, including Iowa, Montana, Nevada, Ohio, Pennsylvania, and Washington.
 
"American families deserve to know how the decisions in Washington are impacting their pocketbooks, their lifestyles, and their livelihoods," said Thomas J. Donohue, president and CEO of the U.S. Chamber. "The U.S. Chamber is committed to presenting the facts to Americans on what lawmakers are doing to help or hurt our economic recovery. We are undertaking this significant effort because, now more than ever, our country needs policymakers who will support pro-growth solutions. The business community is going to work earlier and harder to hold Washington accountable for actions that stifle economic growth and slow job creation."
 
In 2012, the Chamber will launch its largest voter education and grassroots mobilization campaign in its nearly 100 year history. Themes will focus on a pro-jobs agenda as well as holding members of Congress and candidates accountable for their positions on health care, energy, labor, and regulatory issues among others. The Chamber's
Jobs Agenda will serve as the backbone for this strategy.
 
The U.S. Chamber has an opportunity to capitalize on the successes from 2010 and will implement a strategy of "Advance and Protect" in 2012; Advance its interests in the Senate and Protect the pro-growth gains in the House.
